Terms of Service
These Terms govern your use of the AIGENT NOIR FSBO iOS application and fsbo.aigentnoir.com. By using the app, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using AIGENT NOIR FSBO ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
You must be at least 18 years old and legally capable of entering into contracts to use the App. By using the App, you represent that you meet these requirements.
2. AI Content Disclaimer
AI-generated content is not professional advice. The App uses artificial intelligence to provide information about real estate transactions, property valuations, offer analysis, and related topics. This content is for informational purposes only and does not constitute:
- Professional real estate advice or brokerage services
- Legal advice or legal representation
- Financial, tax, or investment advice
- An appraisal or certified property valuation
AI responses may be inaccurate, incomplete, or outdated. Always consult qualified professionals for real estate, legal, and financial decisions. AIGENT NOIR is not a licensed real estate broker.
3. Buyer Safety Disclaimer
The App facilitates direct communication between home sellers and prospective buyers. You are solely responsible for:
- Verifying the identity of buyers before sharing personal information or scheduling showings.
- Taking appropriate safety precautions when hosting showings, including having another person present.
- Not disclosing sensitive financial or personal information to unverified parties.
The App's scam detection and buyer screening features are provided as tools to assist you — they are not guarantees. AIGENT NOIR is not responsible for any harm arising from interactions with buyers facilitated through the App.
4. Subscriptions & Billing
Pro Subscription
- The Pro plan is billed at $79.99/month via Apple In-App Purchase.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- You may cancel anytime through your Apple ID settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period.
- Apple manages all billing. AIGENT NOIR does not have access to your payment card information.
- No refunds are issued for partial billing periods, except as required by applicable law or Apple's refund policies.
MLS Listing Fee
- Submitting your property to the MLS (Multiple Listing Service) is a one-time fee of $199.
- This fee covers the listing submission process only. MLS listing is subject to acceptance by the applicable MLS organization.
- The MLS listing fee is non-refundable once the listing has been submitted.
Free Tier
- A free tier is available with limited features. We reserve the right to modify or discontinue the free tier at any time with 30 days' notice.
5. Fair Housing Act Compliance
AIGENT NOIR FSBO is committed to compliance with the Fair Housing Act and all applicable federal, state, and local fair housing laws. You agree that you will not use the App to:
- Discriminate against any buyer or prospective buyer based on race, color, national origin, religion, sex, familial status, disability, or any other protected class.
- Create listings, communications, or screening criteria that have a discriminatory effect, even if unintentional.
- Use AI-generated content in a way that results in discriminatory outcomes.
Violations of fair housing laws may result in immediate account termination and may subject you to civil and criminal liability. If you believe the App has facilitated a fair housing violation, contact us immediately at support@aigentnoir.com.
6. Your Responsibilities
- You are responsible for the accuracy of all listing information you provide, including property description, disclosures, and pricing.
- You are responsible for complying with all applicable real estate disclosure laws in your jurisdiction.
- You may not use the App to list properties you do not own or have authority to sell.
- You may not misuse AI features to generate false, misleading, or deceptive content.
- You may not attempt to reverse engineer, scrape, or interfere with the App's systems.
7. Intellectual Property
The App, its design, code, and branding are owned by AIGENT NOIR and protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you create (listings, photos, messages), and grant AIGENT NOIR a limited license to display and process that content to provide the service.
8. Limitation of Liability
To the maximum extent permitted by law, AIGENT NOIR and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or business opportunities.
- Damages arising from reliance on AI-generated content.
- Harm arising from interactions with buyers, sellers, or third parties facilitated through the App.
- Interruptions, errors, or unavailability of the App or third-party services.
Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
10. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms, fraudulent activity, or at our discretion with reasonable notice. You may terminate your account at any time through the App's settings. Termination does not entitle you to a refund of subscription fees already paid.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 30 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
